Terms and Conditions

These terms and conditions govern your use of Reliance Foundation (“RF”) Skilling Academy, that is a web-based portal and application (“Portal”) offered through this website (“Site”), any mobile or internet connected device. Your (“you”, “your” or “user”) use of the Portal and the Site is subject to these Terms and Conditions (“Terms”). By accessing the Portal and / or the Site you are agreeing to abide by all Terms. Before you proceed with your registration to this Portal, carefully read and accept the following Terms and check the consent form at the end of the document.

The content and intellectual property on the Portal and / or the Site may be used for the purposes of private, non-commercial viewing only. Any other use, including unauthorised downloading, reproduction, copying, modification, distribution, re-publication, display or performance of the content of this Portal and/or the Site is strictly prohibited without the express written consent of RF.

RF expressly reserves the right to make changes to the Portal and / or Site, including but not limited to these Terms and Privacy Policy at any time. Any changes shall be deemed to have been accepted if you continue to access or use the Portal and/or the Site.

Portal Overview

• The Portal aims to provide access to modules pertaining to, inter alia, skill development (“Skill Development Module”), mentorship (“Mentorship Module”); and job opportunities (“Job Module”).

  • www.rfskillingacademy.com/terms-use-job-opportunities for the Job Module (individually referred to as “Module Terms of Use” and together “Modules Terms of Use”). Provided that, in the event that RF introduces any more modules, the detailed terms of use for such modules shall be deemed to be included by reference in these Terms.
• Alongwith the Terms mentioned herein, you, by accessing the Program on the Portal, also agree to abide by the terms and conditions set out in the Module Terms of Use, as amended from time to time.
• In the event of any conflict between these Terms and the Module Terms of Use for any specific Program, the Module Terms of Use shall prevail.

Eligibility

• By agreeing to these Terms, you represent that you are legally competent to enter into an agreement and provide consent to these Terms. You further represent that:
  • You are of sound mind;
  • You are above 18 years of age and legally competent to enter into an agreement and provide consent to these Terms;
  • You are not prohibited from entering into a legally binding contract as per applicable laws; and
  • You meet the eligibility criteria as specified in the Module Terms of Use to participate in the Program.
• Alongwith the Terms mentioned herein, you, by accessing the Program on the Portal, also agree to abide by the terms and conditions set out in the Module Terms of Use, as amended from time to time.
• In the event of any conflict between these Terms and the Module Terms of Use for any specific Program, the Module Terms of Use shall prevail.
• In the event the Site and/or the Portal is being accessed for the benefit of a minor, you expressly confirm that you are legally competent and authorised to provide consent on behalf of such a minor and the minor’s use of the Site and the Portal shall be subject to these Terms.
• RF and the organisers of the Program, as also mentioned in the Module Terms of Use, reserve the right to blacklist and disqualify individuals without prior intimation in its/their sole discretion and without any liability arising thereof. Once blacklisted from the Program, an individual is not eligible to participate as a mentee or as a mentor, or otherwise for any activity on the Portal.

Registration

• By registering for the Program, you confirm that you have read, understood, and agreed to the registration, matching process and terms as outlined in the Module Terms of Use.
• You confirm that you shall only create, access, and/or use only one user account, unless expressly permitted by RF and you will not share access to your account or access information for your account with any third party.
• You confirm that all information provided during the registration process for the Program is complete, true and verifiable. You agree to update your information to keep it accurate and complete.
• While the Program will try its best to suggest suitable mentor-mentee pairing for the Mentorship Module based on your preferences, the Program cannot guarantee a perfect match for every participant.
• You are responsible for maintaining the confidentiality of your account access information and passwords. You shall be responsible for all uses of your registrations and passwords, whether or not authorized by you. You are not authorized to share your password or other pieces of information related to the access of your account, with any other party, temporarily or permanently. A breach of this obligation may tantamount to disabling your account. You agree to immediately notify RF of any unauthorized use of your account, and passwords.

Feedback and Evaluation

• You agree to participate in Program evaluations, surveys, or feedback requests to analyse the impact of the Program and thereby improve the quality of the Program.
• You consent to the Program including testimonials and survey data for marketing and promotional purposes.

Privacy Policy

• These Terms include the privacy terms available at https://reliancefoundation.org/privacy-policy; and such privacy terms are incorporated into these Terms by reference
• By participating in the Program, you commit to respecting the confidentiality of information shared by your counterparts and shall not disclose sensitive or proprietary information to third parties. Whenever you give us personal data, you are consenting to its collection and use in accordance with our Privacy Policy.

Intellectual Property Rights, License to Use and Third Party Content

• This Site and Portal and its content are protected by copyright, database rights and other intellectual property rights. No right to use or license any of those intellectual property rights is granted except as explicitly set out in these Terms.
• The logos, service marks and trade names (collectively the "Intellectual Property") displayed on the Site and the Portal available through the Site and the Portal are the Intellectual Property of RF, its licensors and others, and may not be used unless authorized by the respective Intellectual Property owner. All Intellectual Property not owned by us that appear on the Site and the Portal, if any, are the property of their respective owners. Nothing contained on the Site and the Portal should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Intellectual Property displayed on the Site and the Portal without RF’s written permission or that of the third party rights holder. Your misuse of the Intellectual Property displayed on the Site and the Portal is strictly prohibited. RF reserves the right to aggressively enforce its Intellectual Property rights to the fullest extent of the law, including the seeking of criminal prosecution.
• You may read, print and download one copy of parts of the material and information on the Site and Portal and store it on a single computer for your personal, private use, but you must reproduce all copyright and other notices. You may not make any profit from the use of that material or information and you may not make any other copies, or adapt, create any work derived from, republish, make available to the public, disseminate, or transmit any of it, or exploit any of it for any commercial purpose, without first obtaining RF’s written permission.
• Subject to these Terms and the policies/guidelines referenced herein, we grant you a limited, personal, non-exclusive, non-transferable and revocable license right to use our Services.
• If you submit any material for inclusion on the Site and Portal (including any posting to any part of the Site and Portal), you grant us an indefinite, royalty-free, worldwide, non-exclusive license to use, reproduce, modify, adapt, translate and make available to the public, combine or include in other works, that material and any extracts from it. We may grant sub-licenses of these rights.
• RF shall own the title, interest and rights, including all related intellectual property rights, in/of the Portal including but not limited to, features of services, which is/are protected by the applicable laws except the content owned by the user and/or any third party/partner. You acknowledge that such ownership shall include all intellectual property rights arising from any suggestions, enhancement requests, recommendations or other information provided by the user, whether during use of the Portal or otherwise. In using the Portal and/or the Site, you hereby irrevocably waive any and all rights that may be available to you under applicable law, whether present or future, to claim any ownership or benefit arising out of any intellectual property that may be developed by RF and/or its affiliates as a direct result of your usage of the Portal and/or the Services.

General

• When you register on the Site and /or Portal and / or Program, you will be asked to provide RF with certain information including, without limitation, a valid email address (your “Information”). In addition to agreeing to these Terms and privacy policy, you declare that you understand and agree that RF may disclose to third parties, on an anonymous basis, certain aggregate information contained in your registration application. [RF will not disclose to any third party your name, address, e-mail address or telephone number without your prior consent, except when it is necessary or appropriate to comply with applicable laws or in legal proceedings where such information is relevant.]
• RF reserves the right to offer third party services and products to you based on the preferences that you identify during your registration and any time thereafter; such offers may be made by RF or by third parties. Please see the privacy policy for further details regarding your information.
• Without limiting any of the other disclaimers of warranty set forth in these Terms, RF does not provide a warranty or guaranty or make any representation as to the quality or nature of any of the third party products or services accessed through the Site and / or the Portal and / or Program. Any such undertaking, representation, warranty or guaranty would be furnished solely by the provider of the applicable class, or learning material(s), product(s) or service(s), under the terms agreed to by such provider.
• By using the Portal and /or the Site you hereby agree to ensure that the explicit prohibitions mentioned in section VII(f) are at all times adhered to. RF may use and/ or develop advanced technologies to detect any misuse of the services provided on the Portal and/or the Site.
• In the context of the service of 'alerts' being introduced by RF; you consent to the use of your personal data in the form of cellular phone number(s) and/ or email address being used by RF to forward relevant information as and when they become available.
• You shall not host, display, upload, modify, publish, transmit, update or share any information which:
  • Belongs to another person and to which you do not have any right to;
  • Is obscene, pornographic, paedophilic, libellous, invasive of another's privacy, including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence;
  • Is misleading in any way;
  • Is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;
  • Harassing or advocates harassment of another person;
  • Involves the transmission of “junk mail”, “chained letters”, or unsolicited mass mailing or “spamming” or similar activities;
  • Promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
  • Infringes upon or violates any third party's rights (including, but not limited to, intellectual property rights, rights of privacy or rights of publicity);
  • Promotes an illegal or unauthorized copy of another person’s copyrighted work;
  • Provides instructional information about illegal activities such as making and/ or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;
  • Solicits gambling or engages in any gambling activity which we in our sole discretion believe is or could be construed to be as illegal;
  • Harms minors in any way;
  • Violates any law for the time being in force;
  • Impersonates another person;
  • Contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information;
  • Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states,
  • or public order or causes incitement to the commission of any cognizable offense or prevents investigation of any offense or is insulting any other nation.

Liability and Caution

• RF is not responsible for the skills, experience, character, circumstances or other attributes of any mentor or mentee or module or job opportunity or course.
• RF shall not be held accountable for any losses, damages, costs, or liabilities suffered by the user, mentor, mentee, or any third party arising from these Terms, the existence of relationships between the parties, services rendered, or actions or omissions of the mentor or mentee or any other person.
• Participation in the Program/Portal is completely voluntary.
• The user’s thoughts and opinions are completely their own and do not reflect the views of RF.
• To the fullest extent possible by law, RF’s maximum liability arising out of or in connection with the Site and / or Portal and / or Program or your use of the Site and / or Portal and / or Program, regardless of the cause of action (whether in contract, tort, breach of warranty or otherwise), will not exceed INR 1,000/-.
• The user is hereby informed that RF has neither appointed nor authorised any person or agency to act on its behalf that is not already provided for in these Terms and/or the Module Terms of Use. The user is advised to not deal with any unscrupulous persons/agencies outside of the portal and the scope of the Terms and Module Terms of Use. RF will not be responsible or liable in any manner whatsoever for any loss suffered directly or indirectly as a result of dealing with: (i) any such persons and/or agencies; and/or (ii) any activities outside the scope of the Portal, these Terms and the Module Terms of Use.
• We request you to promptly notify the local law enforcement authorities and simultaneously write to us at rf.scholarships@reliancefoundation.org in case you come across any fraudulent incident or have any information regarding solicitation for purported offer of scholarships or other benefits in the name of RF.

Indemnification

• You agree to defend, indemnify and hold harmless RF, independent contractors, service providers, consultants, licensors, agents, and representatives, and each of their respective directors, officers and employees, from and against any and all claims, losses, liability, damages, and/or costs (including, but not limited to, reasonable attorney fees and costs) arising from or related to (a) your access to or use of the Portal and/or Services; (b) Your violation of these Terms or any applicable law(s); (c) your violation of any rights of another person/ entity, including infringement of their intellectual property rights; or (d) your conduct in connection with the Portal.

Termination

• Unless otherwise provided in these Terms, the Services offered to you may be terminated by RF without assigning any reasons at any time at the sole discretion of RF. Upon termination / suspension, you shall not have the right to use or access the Portal/Services. RF reserves the right to suspend and/ or terminate your access to the Services in case of any non-adherence to these Terms by you.

Accuracy of Information and Disclaimer

• To the fullest extent possible by law, in no event shall RF, its suppliers, or any third parties mentioned on any RF site be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data, lost employment opportunity or business interruption) resulting from the use or inability to use the Site and / or Portal, whether based on warranty, contract, tort, or any other legal theory, and whether or not RF is advised of the possibility of such damages.
• RF tries to ensure that any information and content on the Site and Portal that has not been supplied by a third party is accurate, but RF makes no representation and gives no warranty that any information or content is accurate, up to date or complete. RF accepts no liability for any loss or damage caused by inaccurate, out of date or incomplete information or content.
• If you find any inaccurate, out of date or incomplete information, or content on this website, or if you suspect that something is an infringement of intellectual property rights or unlawful, you must let us know immediately by contacting us at - rfskilling.academy@reliancefoundation.org
• You should independently verify any information and content on the Site and Portal before relying on it. The information and content on, and software available through, the Site and Portal are not intended to address any particular requirements; they do not constitute any form of advice or recommendation by RF and are not intended to be relied upon when making (or refraining from making) any decision.
• While due care has been taken to ensure that Site and the Portal is kept free of all viruses RF shall not be liable in any manner whatsoever for any damages of any kind arising from the operation, content or use of the Site and the Portal.
• All information and material on Site and the Portal is provided on the basis that RF shall have no liability for that information or material.
• RF shall have no liability for the inability of anyone to access the Site and the Portal or any information or material on it.
• RF does not warrant that Site and / or the Portal will operate without interruption or will always be available.

Governing Law and Dispute Resolution

• These Terms are governed and construed in accordance with the laws of India. The courts in Mumbai shall have exclusive jurisdiction to hear disputes arising out of these Terms.

Force Majeure

• RF shall be under no liability whatsoever in the event of non-availability of any portion of the Site and/ or Portal or the services provided therein occasioned by act of God, war, disease, revolution, riot, civil commotion, strike, lockout, flood, fire, failure of any public utility, manmade disaster, infrastructure failure or any other cause whatsoever beyond the control of RF.

Links to third party sites

• The Site, Portal and Program contain links to third-party web sites. These links are provided solely as a convenience to you and not as an endorsement, by RF, of the contents on such third-party web sites. RF is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third party web sites. If you decide to access linked third-party web sites, it is understood, therefore, that, you do so at your own risk.

Severability

• If any of the provisions of these Terms are deemed invalid, void, or for any reason unenforceable, that part of these Terms will be deemed severable and will not affect the validity and enforceability of any remaining provisions of these Terms.

Consent

• You confirm that you have read and understood the Portal Terms and Conditions, and hereby expressly agree to abide by them. You understand that your participation in the Portal is contingent upon your acceptance of these terms.
